Objection to increases

There are two types of rent increases, namely an increase in the basic rent or an increase in the advance service costs.

  1. Increase in basic rent: The landlord may index the basic rent every year. There are specific rules about the amount of this increase. 
  2. Increase in advance for service costs: After providing the annual statement of service costs and utilities, the landlord may increase the advance amount if it appears that the current advance amount is insufficient.

Do I always have to agree to an increase?

No, there are reasons not to agree to an increase. This reason is laid down in law for both the basic rent and the advance amount for service costs, although these reasons differ between homes in the private sector and homes in the social sector. Consider increasing with an incorrect percentage, while the rent is already too high, if there is an all-in rental price or if no annual statement has been sent.
